AI Regulation in Australia: Where Things Stand in March 2026
If you’re trying to understand the regulatory environment for artificial intelligence in Australia right now, the honest answer is: it’s complicated. There isn’t a single, comprehensive AI regulation framework. Instead, there’s a mix of voluntary guidelines, sector-specific regulations with AI implications, pending legislation, and a lot of “wait and see.”
For businesses building or deploying AI, this ambiguity creates real challenges. You can’t comply with rules that don’t exist yet, but you also can’t afford to build systems that will need expensive retrofitting when the rules arrive.
Here’s where things stand as of March 2026.
The Voluntary Framework
Australia’s current approach to AI governance rests primarily on the Department of Industry, Science and Resources’ AI Ethics Framework. Published in its current form in 2024, the framework establishes eight principles: human, societal and environmental wellbeing; human-centred values; fairness; privacy protection and security; reliability and safety; transparency and explainability; contestability; and accountability.
The framework is voluntary. No penalties for non-compliance. No reporting requirements. No enforcement mechanism. Organisations can adopt it, partially adopt it, or ignore it entirely.
In practice, adoption is patchy. Large organisations — particularly those in regulated sectors like banking and healthcare — have generally aligned their AI governance with the framework’s principles, partly because their existing regulatory obligations already cover similar ground. Smaller companies and startups have largely not engaged with it, either because they’re unaware of it or because voluntary frameworks don’t drive action when resources are limited.
The voluntary approach was always framed as a first step, with mandatory requirements expected to follow. That “follow” has been slower than many anticipated.
Sector-Specific Rules
While a general AI law hasn’t materialised, several sector-specific regulatory developments have AI implications.
Financial services. APRA has been the most proactive regulator. Its guidance on the use of AI in financial services, released in late 2025, establishes expectations around model risk management, explainability for consumer-facing decisions, and data governance. It stops short of prescriptive rules but makes clear that APRA will hold regulated entities accountable for AI-related outcomes through existing prudential standards.
Healthcare. The Therapeutic Goods Administration has clarified that AI-powered medical devices fall under existing regulatory frameworks and require assessment proportionate to their risk classification. Clinical decision support tools using AI are being scrutinised more carefully, with new guidance on validation requirements expected in mid-2026.
Employment. The Fair Work Commission has begun considering how AI affects workplace relations — algorithmic management, AI-assisted hiring decisions, and automated performance monitoring. No formal rules yet, but several test cases are working through the system that will set precedents.
Privacy. The Privacy Act review, still being implemented, includes provisions directly relevant to AI. Proposed reforms around automated decision-making, the right to meaningful explanation of decisions affecting individuals, and restrictions on facial recognition technology would, if enacted, create binding obligations for AI deployments that process personal information.
The Pending Legislation
The Australian Government has signalled its intention to introduce mandatory guardrails for high-risk AI applications. The term “high-risk” is doing a lot of heavy lifting in this conversation, and the definition remains contested.
The general direction — informed by the government’s response to its own consultation processes and by international precedents, particularly the EU AI Act — is a risk-based approach. Low-risk AI applications would face minimal or no additional regulation. High-risk applications — those affecting health, safety, legal rights, or critical infrastructure — would face mandatory requirements around testing, documentation, human oversight, and transparency.
The timeline is uncertain. A consultation draft was expected in early 2026 but has been delayed, with no confirmed release date. Industry groups are lobbying for a light-touch approach. Civil society organisations are pushing for stronger protections. The government appears to be seeking a middle path, which in Australian politics often means things take longer than anyone expects.
What Businesses Should Be Doing Now
The regulatory ambiguity isn’t an excuse for inaction. Here’s what prudent organisations are doing.
Documenting AI deployments. You can’t govern what you can’t see. Building a register of all AI systems in use — what they do, what data they process, who’s responsible for them, and what decisions they influence — is foundational regardless of what the eventual regulations require.
Applying the voluntary framework seriously. Yes, it’s voluntary. But it represents the government’s stated view of responsible AI practices, and any mandatory requirements that emerge will almost certainly be consistent with its principles. Organisations that have already aligned with the framework will have less work to do when rules become binding.
Watching international developments. The EU AI Act is now in effect and Australian companies operating in European markets or with European customers are already subject to it. Australia’s eventual framework will be influenced by the EU approach. Understanding what the EU requires provides a reasonable preview of where Australia is heading.

Businesses making investment decisions about AI need to understand the rules they’ll be operating under. Every month of ambiguity is a month where some companies invest cautiously, waiting for clarity, while others move fast and hope the rules won’t require expensive changes.
Some regulatory clarity, even if imperfect, would be more valuable to the ecosystem than continued deliberation. Australia doesn’t need to copy the EU’s approach wholesale. But it does need to signal clearly what “high-risk” means, what obligations will attach, and when compliance will be expected.
The AI regulation conversation in Australia isn’t finished. But it needs to move faster. The technology already has.
